Abstract
Arbitration and Dispute Settlement in Electronic Commerce has been key to expanding the economy and enriching the modern lifestyle of citizens in many countries, when managed effectively. Arbitration and Dispute Settlement in Electronic Commerce, globally, has become an efficient form of commerce and has recently become more feasible in Saudi Arabia due to the development of laws and protections. This comparative and analytical study explores Saudi Arbitration and Dispute Settlement in relation to international commerce and consumer laws to show the importance of legislation and other means of protecting consumers and the e-commerce process.
Beginning with a background and a literature review, the researcher explores Arbitration and Dispute Settlement in Electronic Commerce in Saudi Law current literature relating to e-commerce and consumer protection. The major question, why consumers need Arbitration and Dispute Settlement and what entities are responsible for that within different jurisdictions and during different types of transactions.
The researcher presents methods of dispute settlement with a focus on the advantages of disadvantages of arbitration, including applicable law in dispute resolution. This leads to the researcher's response to the main question of how to protect Saudi consumers in Arbitration and Dispute Settlement.
The researcher concludes with recommendations for the Saudi Ministry of Commerce, Ministry of Justice as well as tribunals in Saudi Arabia to efficiently protect consumers and the e-commerce process.
